For those of you who may not have seen it on the news, on April 25 in Colorado the was a fiery and deadly accident when a semi loaded with lumber slammed into cars stopped for another accident on I-70. Four people were killed and many more were injured.
The driver, Rogel Lazaro Aguilera-Mederos, 23, of Texas claims his brakes failed and that is what lead to the accident. The video shows an out of control truck which may be the result of the driver traveling to fast, overheating his brakes and panicking.
He has been charged with the following.
Six counts of first-degree assault
· 24 counts of attempted first-degree assault
· Four counts of vehicular homicide by reckless driving
· Two counts of vehicular assault by reckless driving
· One count of reckless driving
· Two counts of violent crime causing death or serious bodily injury
· One count of violent crime using a weapon
So it turns out this guy is here on a green card from Cuba. He claims he doesn’t speak English. Big problem.
Federal Motor Carrier Safety Administration, at 49 CFR 391.11, requires that in order to get a Commercial Driver’s License, an applicant must be able to “read andspeak the English language sufficiently to converse with the general public, to understand highway traffic signs and signals in the English language.
His bail was set at $400,000. I’m not here to determine guilt or innocence, but it doesn’t look good.
Aguilera-Mederos was working for the Houston-based trucking company Castellano 03 Trucking LLC at the time of the crash. Over the past two years, the company has had 30 safety violations, including problems with brakes and a weak grasp of English, according to federal records. Twice in 2018, the drivers of one of the fleet’s trucks was found in violation of the rule that requires drivers to understand highway traffic signs and signals in English.
Here is the part that will piss you off. The attempts to raise money for this guy.
This appears to be closed, but his wife is still accepting donations.
Of course to much money could blow the free legal funds. And I’m guessing not everyone had something nice to say about him. Here is the bigger problem. He makes bail he is out of here.
He doesn’t speak English and neither does his wife. They are both from Cuba. If he gets out they are running to Miami where the Cuban community will hide him and smuggle them back to Cuba. I can almost guarantee that.
A fair trial for him and justice for the victims should be served. But I hope he doesn’t make bail, otherwise that will never happen. Of course, if this was Massachusetts a nice liberal judge would have released him on a pinky swear and then given him to a ride to the airport in a state owned car.
